Introduction

These Terms of Service ("Terms") govern your access to and use of the ImagineGo.ai website and services (the "Service"). By using the Service, you agree to these Terms.

Accounts

• You must provide accurate information and keep your account secure.
• You are responsible for all activity under your account.
• We may suspend or terminate accounts that violate these Terms.

Acceptable Use

• Do not use the Service to break laws, infringe intellectual property, or distribute harmful content.
• Do not attempt to reverse engineer, disrupt, or impair the Service.
• Respect others’ rights and privacy. Do not upload content you do not have rights to (e.g., copyrighted photos, images of individuals without consent).
• Do not generate, request, upload, transform, or distribute NSFW, pornographic, nude, semi-nude, sexually explicit, or sexually suggestive content through the Service.
• Do not use the Service for deepfakes, face swaps, impersonation, or deceptive identity manipulation.
• Do not attempt to bypass safety filters, moderation controls, or provider restrictions.

Content Moderation

The platform uses a multi-layer moderation system combining automated review, human review, and periodic sampling.

Automated Review (Real-Time)

All generation requests and related inputs are scanned in real time by safety filters before processing continues.

• Input filtering: Prompts are checked for keywords, semantic risk, and intent signals.
• Output filtering: Generated content may be evaluated against safety rules where supported by the pipeline.
• Usage pattern analysis: We monitor abnormal API or account activity that may indicate abuse or policy evasion.
• Safety model: We use the Creem Moderation API for prompt safety screening. Additional provider-level safety controls from third-party AI model providers may also apply.

Automated decisions may include allow, flag, or deny. Denied requests will not proceed to generation. Flagged requests may be blocked pending further review.

Human Review

• Content automatically flagged by moderation systems may be placed into a human review queue.
• User reports are reviewed by our trust and safety team.
• Reviewers are expected to follow content-safety training and confidentiality requirements.
• We may request additional information from you when investigating a report or enforcement action.

Periodic Sampling and Audit

• We conduct periodic random sampling of requests, outputs, and enforcement decisions to assess policy compliance.
• We regularly evaluate and improve the accuracy of automated moderation systems.
• We may engage independent third-party audits or reviews where required by law, payment partners, or internal risk controls.

Content Risk Levels

Enforcement and Appeals

• We may block prompts, refuse generations, remove outputs, limit features, suspend accounts, or terminate accounts based on moderation results and risk level.
• Credits consumed by blocked or refused generations are handled according to our credits and refund rules and applicable law.
• If you believe a moderation decision was made in error, contact us at [email protected]. We may reverse a decision after review, but we are not obligated to restore removed content or reverse enforcement in every case.

Content and Ownership

• Your Inputs and Outputs: You retain rights to the content you input (prompts and reference images) and the outputs generated, subject to applicable law and provider terms. You grant us a limited license to process and store content as needed to operate, secure, and improve the Service (e.g., temporary caching, abuse prevention, and safety improvements).
• Our Content: All site materials, trademarks, and software are owned by us or our licensors and are protected by law. Do not copy or reuse without permission unless expressly allowed.

AI‑Generated Outputs

• Outputs may be inaccurate or incomplete. Use your own judgment and verify facts before relying on outputs.
• You are responsible for how you use generated content, including ensuring compliance with laws and third‑party rights.
• Some features rely on third‑party model providers. Processing may be subject to their terms.

Credits, Payments, and Pricing

• ImagineGo.ai operates on a credit-based system. Credits are used to access AI image and video generation features.
• Credits are purchased as one-time packages and do not expire.
• Payments are processed by third‑party providers. Taxes may apply.
• Credits are non-refundable once purchased, except where required by applicable law.
• Pricing Adjustments: Model pricing may fluctuate slightly due to changes from upstream AI service providers. We will make reasonable efforts to notify users of significant pricing changes in advance.
• Credit prices and package options may be updated from time to time. Current pricing is always displayed on the pricing page.

Privacy

Our Privacy Policy describes how we collect and use information.

Third‑Party Services

The Service may integrate with third‑party tools (e.g., cloud storage, analytics, AI model providers). We are not responsible for third‑party content, terms, or policies.

Disclaimers

• The Service is provided "as is" without warranties of any kind.
• We do not guarantee error‑free or uninterrupted operation.
• AI model availability and performance may vary based on third-party provider status.

Limitation of Liability

To the maximum extent permitted by law, we and our suppliers will not be liable for indirect, incidental, special, or consequential damages, or any loss of profits or data.

You agree to indemnify and hold us harmless from claims arising out of your use of the Service or violation of these Terms.

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or for security/legal reasons. Unused credits will not be refunded upon termination.

These Terms will be governed by the laws applicable in our primary place of business, without regard to conflict of law rules.
